The differing approach to commercial litigation in the European Court of Justice and the courts of England and Wales
Article Abstract:
The different approaches taken by the English courts and the European Court of Justice (the ECJ) related to the exercise of its jurisdiction in civil and commercial matters are discussed. The well-known cases that underline ECJ's approach to anti-suit injunctions with markedly different approach are Erich Gasser GmbH v MISAT Srl, Turner v Grovit and Owusu v Jackson.
