The "new franchise paradigm": an alternative view
Article Abstract:
A so-called new paradigm for franchises, which emphasizes viewing them as shared business ventures, fails to acknowledge that franchisors and franchisees already share mutual interests. Franchise agreements can be drafted under existing rules so as to provide both franchisee and franchisor with adequate discretion and authority. Problems arise when franchisees become blind to the advantages of franchisor-required training or other initiatives designed to promote the success of the overall system. Although franchisee input is important, franchisors must have a free hand to run their businesses properly.

The authors analyze the trend among many types of business operations toward large multi-unit franchisees. Franchisor objections to franchisee growth are outlined and relevant law suits are discussed.
