Trustbusters try to see through Windows 98; PC vendors still bundling Microsoft browser, despite Justice's action
Article Abstract:
Computer stores are still bundling Microsoft Corp's Internet Explorer (IE) 4.0 browser with Windows 95 in spite of the Department of Justice's Jan 22, 1998, agreement that Microsoft would license the operating system but remove the browser icon from computer desktops. Testimony from a Compaq Corp executive revealed that a browser partnership with Netscape Communications Inc was ended after Microsoft threatened to terminate Compaq's license for Windows if the IE icon was not reinstalled. A challenge to Microsoft's contractual challenges may do better than one concerning product design.

Article Abstract:
Sullivan and Cromwell will face Department of Justice lawyer David Boies in the Microsoft antitrust trial. Boies, a star trial lawyer with much experience, will face Sullivan & Cromwell's John L. Warden, better known for his appellate work. Richard J. Urowsky and a team of about 10 Sullivan and Cromwell lawyers will help. Government lawyers who have faced Urowsky in other parts of the Microsoft case say his style matches that of the company, which tends to play for keeps in every confrontation.

Aren't Intel, Microsoft just utilities? Maybe, but FTC and DOJ shun 'essential facility' case
Article Abstract:
Critics target the 'essential facilities' doctrine when applied beyond regulated monopolies such as electrical power systems and railroads, and plaintiffs have enjoyed little success with the doctrine outside the regulated industry area. That is why the Department of Justice's 1998 antitrust complaint against the Microsoft Corp did not use the theory, and the FTC is likely to follow suit in its investigation of the Intel Corp.
