Simplification is the key to effective trial practice in complex intellectual property litigation. Trial practicing this specialty must be aware that jurors form their story or interpretation of the case early in the trial and communicate a trial narrative of their own that pre-empts imposition of the juror's story based on the evidence. A checklist of further communication pointers is given.

Various problems in defending mega-litigation are discussed, and these can involve thousands thousands of complaints filed in different jurisdictions, but all involving the same issues. Establishing a system for detecting the first signs of mega-litigation and a rapid-response team are crucial. The example cited is the litigation regarding the anti-obesity drug Redux.
