What's the future going '2B'? Drafters eager to get new UCC article going but questions remain
Article Abstract:
The new UCC2B would give the legal standards governing the licensing of computer software and other online information. Among the critics of the proposed law, consumer advocates contend software buyers will not have enough protection from oppressive license terms, while the entertainment industry worries about a disruption of the copyright and common-law rules they rely on. Businesses can continue relying on UCC2 and living with uncertainty in computer-oriented transactions. The drafters of UCC2B are hoping for a 1999 approval.

Posting course materials in a course covering encryption technology on the Internet may be barred by export limits on encryption technology, which is the law because of fears that crime syndicates or terrorists could obtain such technology. Peter Junger is a law professor at Case Western University who teaches such a course who has filed suit, claiming that these particular export controls violate his free speech.

Sizing up sentences
Article Abstract:
The failure of the 1987 sentencing guidelines to really standardize sentences and the disquieting variation in sentences for the same white collar crimes is described. Prosecutors have considerable leeway in how they charge, and the absence of guidelines on the defendant's substantial assistance is another one of the problems.
