Load of liability linked to Web sites; commercial page owners brave IP claims and other legal perils
Article Abstract:
There are a number of legal issues to address for companies thinking of creating an Internet site. Each site requires a domain name and before that name is selected, a full trademark search should take place to make sure there is no infringement. Can programs bind humans to contracts? 'Intelligent agents' capable of shopping the Web and entering 'click wrap' pacts wreak havoc with aged contract and agency laws
Article Abstract:
Both agency and commercial law fail to offer clear guidance on the role of the intelligent agent. Both agent developers and those using click-wrap agreements need to keep the state of the law and agent technology in mind. Until the technological level of intelligent agents is such that they can understand contractual terminology, they are likely to be given more contracting authority than is legitimately and practically appropriate. Web site owners using click-wrap licenses should keep present technological and legal limits in mind.
