Winning the verdict with videos and virtual reality; many traditional forms of evidence are not yet obsolete, but litigators are relying on technology to persuade the jury
Article Abstract:
Disk-based litigation technology (DLT) is one of the new forms of demonstrative evidence appearing in trial courts, and the modern juror is viewing evidence on VCRs and, computer-based display systems. The new highly visual kinds of demonstrative evidence can be both persuasive and emotion-packed. Courts are admitting this evidence so far, as long as it sufficiently explains relevant testimony, is fair and accurate, and does not prejudice jurors. A number of software programs and companies are offering help with these technologies as they become more current.

Article Abstract:
The need to change the old assumption in the Federal Rules of Evidence that photographs and other demonstrative evidence have not been altered is discussed. This change is necessary due to the ease of making these changes with the new digital technology.

Manual processing of electronic data is outdated; counsel can take advantage of services that convert computer images efficiently and quickly
Article Abstract:
Establishing a protocol for the production of electronic records in response to discovery requests is discussed. Converting all electronic data into images leaves less room for human error in electronic evidence production.
