The anti-abortion groups have won passage of new abortion restrictions in many states although federal courts have uniformly ruled the federal 'partial-birth abortion' ban unconstitutional. The South Dakota legislature approved a revised measure in February 2006, but opponents from within the state announced the launch of a petition drive to put the ban before the public in a statewide referendum on November 7, 2006.

South Dakota is regarded as one of the stronger pro-life states, but the proposed state abortion ban was blocked pending a statewide referendum on November 7, 2006. Pro-choice sentiments are most commonly found at the Empire Mall in Democratic-leaning Sioux Falls in mid-September 2006.
