JUSTICES ALLOW POLICY OF SILENCE ON 9/11 DETAINEES
Article Abstract:
The US Supreme Court refused to hear an appeal of a decision by the Court of Appeals for DC that allowed the Justice Dept. to keep secret the names of almost 1,000 individuals who were arrested and detained after the Sept. 11, 2001 attacks on the World Trade Center and Pentagon. Most of the detainees have since been deported for immigration violations. The DOJ did give out 129 of the names, but the Court of Appeals, in a 2 to 1 decision, maintained that revelation of the names or reasons for the detentions would harm the government's efforts to maintain national security and conduct an effective investigation into terrorist threats.

U.S. COURTS REJECT DETENTION POLICY IN 2 TERROR CASES
Article Abstract:
The United States Court of Appeals for the 2nd Circuit (New York) has ruled that the Bush administration has no authority to detain Jose Padilla without legal representation because he is considered an enemy combatant. The Court of Appeals for the 9th Circuit (San Francisco) issued a similar ruling in favor of the alleged 660 enemy combatants who are currently imprisoned at the Guantanamo Bay naval base. It is expected these cases will go to the US Supreme Court which also has to decide if it will accept the case of Yaser Esam Hamdi who has been detained along with Padilla in a Charleston, SC naval brig.
