Legal reasoning and the International Law of Trade: the first steps of the Appellate Body of the WTO
Article Abstract:
The Appellate Body of the World Trade Organization (WTO) has so far been successful in its search for legitimacy through the maintenance of predictability and security in its dispute settlement procedures. The body however, may veer off and instead search for a doctrine that would encompass liberalized trade and may thus compromise its search for legitimacy in the process. The dispute settlement procedure of the WTO has so far been successful in terms of the number of cases being heard but it is yet too early to tell if the system is stable enough.
