NAFTA Chapter 19 and the development of international administrative law - applications in antidumping and competition law
Article Abstract:
International trade regulation applies primarily to governments but may also be applied to private market players in certain cases, such as those involving firms which engage in dumping. In such instances, issues over the fairness and adequacy of administrative practices may arise. Two areas where administrative review may be questioned are in cases involving antidumping and competition laws. Within this context, a study analyzed administrative procedures created in Chapter 19 of the North American Free Trade Agreement of 1992, why they were created and their implications for other areas.
