The functioning of the Appellate Body after four years: towards rule integrity
Article Abstract:
The World Trade Organization (WTO) has created the Appellate Body (AB) as its main dispute settlement arm. The AB performs the duties and function of the General Agreement on Tariffs and Trade (GATT) Panel. Decisions of the AB are confined to findings based on Panel reports. The WTO has designed its policies to encourage the creation of competitive opportunities. It does not aim to create opportunities for actual trade. A primary requirement of the AB prior to settling or hearing a claim is the presence of a legal interest of the complainant.
