The revival of states' rights: a progress report and a proposal
Article Abstract:
The Supreme Court has begun to revive the Constitution's safeguards for state autonomy. Two cases, US v. Lopez in 1995 and Printz v. US in 1997, reaffirmed different aspects of states' rights and federalism. To continue progress in this direction, the Court must do two things. One, it must reexamine the power of Congress to force state action through conditional grants. Second, it should prefer a functionalist analysis over pure historical originalism.
