Three models of affirmative action beneficiaries
Article Abstract:
The debate over affirmative action is based on disparate models of affirmative action beneficiaries. The left favors the outsider group model, which suggests that affirmative action is needed to overcome an imbalance of power. The right, on the other hand, subscribes to the interest group model, which views affirmative action as a benefit for special interest groups that have gained too much power. The adversity group model views affirmative action as a remedy for a group that has been injured through no moral fault of their own. The adversity group model has the advantage of envisioning a moral consensus and stressing the temporary nature of the remedy.

Cutting the Gordian knot of affirmative action
Article Abstract:
The US Court of Appeals for the District of Columbia Circuit struck down affirmative action requirements in Lutheran Church-Missouri Synod v. FCC in 1998. The church disputed the FCC's attempt to impose an affirmative action program on it with regard to two radio stations operated by the church. The Court thus continued the federal courts' policy of striking down affirmative action policies that are based on racial preferences rather than individualized remedies.
