Harnessing the free market: reinsurance models for FDIC deposit insurance pricing
Article Abstract:
The Federal Deposit Insurance Corp. (FDIC) should look to reinsurance models as a way of evaluating free market rates in pricing deposit insurance. The FDIC's reinsurance Pilot Program should provide the private market information needed to help the FDIC reform its policies. However, a reinsurance program could be hampered by factors such as incompatibility between FDIC and private market prices and distorted perceptions of relative risk.

Three proposals to harness private information in contract
Article Abstract:
Contract law should be expanded so that judges may afford more respect to the freedom of contract and private information of contracting parties. Such expansion could include the utilization of three default rules. The foreseeability rule in the English case of Hadley v. Baxendale should be extended to buyers. Defendants should be allowed to choose the inalienability of injunctions and interpretive safe harbors should be supported.
