Trusting antitrust to dump antidumping
Article Abstract:
Adherence to antitrust principles proves to be the best alternative towards elimination of antidumping rules contained in the World Trade Organization framework. Antitrust principles prevent the creation of replacement standards, which are the competition standards, that are believed to hinder movement of dumping cases. It also serves as catalyst towards the speedy removal of antidumping rules which continue to negatively affect domestic market competition.

Professor Alan Sykes' criticism of the text of the Agreement on Safeguards and its application by the Appellate Body is based on their alleged inconsistencies with certain economic theories. His analysis may be economically plausible, but economic plausibility based on certain economic theories is by no means a determinative factor in legal analysis.

Currency conversion in the Anti-dumping Agreement
Article Abstract:
Issues are presented concerning the exchange rate conversion clauses of the Anti-dumping Agreement. The anti-dumping policy of the European Union, which has declined since the early 1990s, is discussed.
