The Property Misdescriptions Act 1991 extends to all those involved in estate agency business, covering both residential and commercial property, applying to solicitors, developers and auctioneers. Misstatements can result in both civil liability and criminal prosecution. With regard to auctions, the offence is committed once the catalogue is sent out, when a false or misleading statement is made about a certain matter. The intention of the person making such a statement is irrelevant, but showing that all reasonable steps were taken to avoid committing the offence is some defence.
