All change for experts
Article Abstract:
The Civil Procedure Rules 1999, which came into force in the UK on Apr 26, 1999, give courts the right to direct that evidence will be given by a single joint expert. If two or more parties want to submit expert evidence on a specific issue, then the court may decide that the evidence on that issue is given by only one expert. It may initially appear that the volume of work for expert witnesses could fall as a result of this legislation, but this will almost certainly not be the case. It is likely that parties to a dispute will wish their own experts to assess a single expert's report, and this will mean that three experts are used, rather than one.
