An open verdict: ECJ has failed to resolve the uncertainty over Article 81 damages claims, so each member state must establish its own guidelines
Article Abstract:
In the case of Courage v Crehan, the European Court of Justice ruled that a co-contractor should be able to claim damages in some restricted circumstances if a term of a contract contravenes Article 81 of the EC Treaty. Courts across Europe will have to establish their own guidelines if face with similar claims for damages for breach of Article 81.
