It is emphasized that the tenant must always obtain advice when negotiating a break clause to ensure that it is unconditional or that all the conditions can be controlled. Any existing lease with a break option held by the landlord or tenant should be checked.

How to patch up repairs disputes

A discussion of the main factors influencing landlords and tenants of commercial property with regard to dilapidations focuses on the valuation basis upon which damages for repair are assessed. The cost of carrying out remedial work contained in a schedule of dilapidations may not equal the diminution in the value of the landlord's reversion.
