Article Abstract:
The UK Court of Appeal dealt with a case of planning permission being granted for a new supermarket which was dependent on the highway authority carrying out some off-site works. The court found that the highway authorities could not reject planning permission if road safety issues had been considered and rejected..The UK Minister for Planning has emphasized the need to review planning procedures for both local and national projects. The Government is consulting interested parties concerning the problem of the increasing amount of traffic causing pollution and congestion.

When the official talks rubbish
Article Abstract:
Changes to planning and environmental policies are not likely to be introduced in the immediate future although the Labour government has many new ideas concerning these matters. Recent decisions made in the UK courts have clarified the situation concerning the use of extraneous evidence in planning applications. Planning officers should ensure that any written or oral information given to an applicant is correct particularly if the case is not straight forward.

Article Abstract:
On receipt of an enforcement notice the recipient must act quickly to lodge an appeal as a time-limit is often integral to the notice. Once an enforcement notice has been served and an appeal has failed the recipient has little hope in perusing the case any further. Over 85% of applications to the planning authorities are passed, with around 40% of those going to appeal finally being permitted. Each year fewer than 5,000 enforcement notices are served.
