Article Abstract:
Pollution liability policies are available for real estate transactions, property development, and environmental redevelopment projects. There are a number of options for specialty real estate deals involving former industrial areas wherein the extent of environmental damage is unknown. Examples include environmental impairment liability insurance (EIL), property transfer liability insurance, environmental stop loss, finite risk combined with stop loss insurance programs, owner controlled environmental insurance programs, and owners protective insurance.

Using interest rate swaps and swaptions in hedging interest rate risk
Article Abstract:
The processes of using interest rate swaps and swaptions as instruments by real estate brokers and lenders in managing interest rate risks are discussed. An interest rate swap is an understanding wherein two parties exchange interest payments according to two different indexes. A swaption provides a holder a right to transact an interest rate swap at an agreed-upon interest rate and period. Swaptions have become the preferred instrument because they offer asymmetric hedging compared to symmetric hedgings by swaps.

Lifting the dead hand of the past: state initiatives for promoting brownfield remediation
Article Abstract:
The brownfield problem is examined using a broad analytical framework and analyzes components of a state remediation program. Factors influencing the production of abandoned, idled or under-utilized industrial and commercial locations were determined. These include deindustrialization, manufacturers' site management and waste disposal policies and practices, and the enactment of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980.
