Estate management schemes - a feudal hangover?
Article Abstract:
The Leasehold Reform Housing and Urban Development Act 1993 allows owners of a large estate to apply for estate management schemes (EMSs), subjecting properties purchased on such estates to a range of obligations. The owners of properties on large estates cannot appeal against an EMS, which can last indefinitely. EMSs are almost feudal in nature, and go against the rule that positive covenants do not run with the land.
