In this question and answer, the issue of a real estate agent's setting a no-cobrokerage stipulation on an oral sales offer and an appraiser handling a seller's appraisal in the case in which the seller thought she could get a higher price for the home. In the first instance, co-brokers must determine in advance what and how much they will be paid, which did not occur in this scenario. In the second case, the broker representing the seller may not have done enough to protect the client's interests, but the appraiser should have referred the seller to a different appraiser to avoid conflict of interest.
