Article Abstract:
The Town and Country Planning (Trees) Regulations 1999 has been substituted for the Town and Country Planning (Tree Preservation Order) Regulations 1969. The British government are looking at introducing impact fees where developers are expected to pay money to the local authorities for some types of development. Planning obligations may remain as they ensure developers provide amenities for the whole community. A case heard in the UK Court of Appeal involved the owner of a Grade II listed building who objected to a condition set out by a planning inspector. The owner was successful.

Article Abstract:
A case heard in the UK legal courts in 1998, clarified the right of defendant to challenge legal validity. The case concerned a builder who failed to comply with a condition notice over the removal of equipment and waste from a building site. The builder was found to have been in control of the land and the condition notice was therefore valid. A second case concerned work on redeveloping Fulham Football Club, London, England. The planning inspectorate decision to allow the redevelopment was challenged by Lady Berkley on two counts which both failed on appeal.
