An internet service provider (ISP) must ensure their contract allows them to immediately erase any illegal or untrue information and they must not accept more data from the same source. The European Commission draft Directive on Electronic Commerce (COM (1999) 427 final) tried to clarify the liability of ISPs throughout its member states. The directive points out an ISP would not be liable of committing a libel if they merely transmitted information. They are not obliged to check if the data is correct. But once they know the information is untrue or illegal it must be removed.
