Developments in lender liability under environmental laws
Article Abstract:
Various laws controlling possible effects of hazardous wastes on human health and the environment have been enacted at the federal and state levels since the 1970s. Liability for violations is imposed by these laws on different parties and cleaning up of contaminated properties can be costly. An overview of some of the more rigid federal laws affecting property owners and operators is presented. It is suggested that lenders should be completely knowledgeable of the liability they face with regards to environmentally contaminated property.
