Article Abstract:
Alternative dispute resolution techniques are well-suited to resolve disputes related to retail leases, especially shopping center leases. The relationship between landlord and tenant in shopping centers is interdependent because the landlord can influence a retailer's success by deciding on the type of tenants that are allowed to conduct business in the shopping center. Some of the issues involved in resolving shopping center lease disputes are discussed.

Lease dispute resolution is discussed in areas such as percentage leases, subletting and assignment, signage and visibility, parking, condemnation, casualty and common area maintenance. Disputes involving percentage leases, based on sales or revenues, can revolve around such issues as the definition of the percentage rent base. Subletting issues are similar to disputes in other commercial leases.

Calculating base building capital expenditures of office buildings
Article Abstract:
Capital expenditure requirements increase for base buildings as these office buildings age and incur higher percentages of net operating income. Market replacement reserve estimates for office buildings are reasonable in 1998 for those buildings erected after 1983. Capital expenditure requirements for buildings constructed prior to 1983 are understated.
