The expert witness
Article Abstract:
Expert witnesses are used as advisers by parties involved in a dispute, and may be required to appear before a judge to produce evidence. Surveyors have a duty to advise clients of both strengths and weaknesses of the client's case, but do not have to advise others of those weaknesses if they negotiate for clients. Expert witnesses are expected to give an honest judgement and shed partiality. This is illustrated in valuation cases where there may be a range within which a valuation could fall, rather than a precise figure.

Personal rights to break
Article Abstract:
UK landlord and tenant law relating to the right to break of tenants has been affected by Brown and Root Technology Ltd v Sun Alliance and London Assurance Co. This case affects the issue of when assignments occur if rights to break are set out in such a way that they cease to exist following an assignment. The case resulted in a ruling in favor of the landlord from Paul Baker QC, the judge involved in this case, where a lease was taken over by a holding company of the tenant.

The UK Property Misdescriptions Act of 1991 has been used by trading standards offices and used to prosecute around 40 estate agents and 4 real estate developers. Nine of these cases have resulted in acquittals and over 50% of the accused admitted guilt. Misleading statements can include pictures as well as words. This was true of a case involving a house which had been photographed and the picture made it appear that it was built of brick, but there was only brick cladding.
