The human rights factor
Article Abstract:
The introduction of the Human Rights Act 1998 in to English law, during the year 2000, will affect property law. The act will have an impact on parts of property law, such as forfeiture by peaceable re-entry and the law of distress. The Distress for Rent Act dates back to 1689. It allows landlords to take the goods of tenants who have not paid their rent and to keep them until the rent is paid. Distress will become unlawful under the Human Rights Act according to Article 1 of Protocol 1 and Articles 6(1) and 8. The UK Law Commission has called for discontinuation of distress.
