The perils of being independent experts

It is likely that an independent expert appointed to determine the market rent of a property within the context of a rent review will come into conflict with either the landlord or the tenant. However, it has not yet proved possible to determine negligence against an independent expert undertaking a rent review. In Lewisham Investment Partnership Ltd v Morgan, the plaintiffs made a number of criticisms of the way in which the defendant, an independent expert, arrived at the market rent. The judge indicated that the key issue was not whether the defendant was right in his choice of valuation method or in making certain deductions.
