The return of reform
Article Abstract:
The discussion document put forward by the UK Department of the Environment, Transport and the Regions on how the planning procedure could be changed has some very worthwhile elements and shows it has been produced by experts in planning. One reform may not be welcomed by those objecting against a plan as they may not be permitted to take part in cross-examination during inquires. The proposal to allow only issues still being disputed during an inquiry may simplify and reduce time spent at inquires. They also recommend decision notices should include all the necessary development plan policies.

No security for landlords
Article Abstract:
Recent legal rulings in UK cases involving landlords and tenants in administration have important implications for landlords. The judge ruled, in a case involving Comchester Properties Ltd. and Clarence Cafe Ltd., that the landlord's peaceable re-entry into his property following the tenants entry into administration did not constitute a legal process and therefore does not prevent the landlord from forfeiting the lease. The ruling indicates that the landlord is not a secured creditor of the tenant. Rulings in two other cases upheld this ruling.
