Twenty key issues in mall lease negotiations

There are 20 main issues that a prospective tenant should evaluate before signing a lease on a shopping mall site. These issues include the terms of a construction agreement, increases in rent, property alterations and co-tenancy. Additional issues include relocation, common area costs and the merchant's association. Careful negotiation of these 20 issues will assist a tenant in their relationship with their landlord and the mall for the term of the lease.

Percentage rent leases: an update
Article Abstract:
An overview of the percentage lease, the standard type of retail-space lease is presented. The percentage lease developed after World War II, as new shopping centers, hoping to attract tenant stores, devised a lease that would initially keep rents low, while allowing them to participate in stores' growth. The nine major percentage-rent variations are discussed.

The shopping center percentage lease

Almost all leases for stores in large shopping centers include percentage-rent provisions, under which rental amounts owed are based at least in part on tenant income. Most percentage-rent leases specify a fixed minimum rent, however. Basic information on shopping center percentage leases is presented.
