Article Abstract:
The case of Oliver & Sons Ltd, Petitioners [1999] SLT 1039 has highlighted the problems associated with evicting unidentified occupiers of areas of land. It is clear that those who have areas of land that are vulnerable to incursion can suffer significant losses and costs. This case indicates the extent to which both lawyers and the underlying legal system can adapt procedures to practical goals where there is a real problem. The Inner House identified a distinction between being able to name people and being able to identify them as those who would be given copies of the court order for eviction.

Issues concerning the rules of telecommunications masts in Scotland planning are discussed. Particular attention is given to fears that masts could affects the health of people living nearby and to policy provisions regarding mast building.
