Valuation of special declarant and development rights
Article Abstract:
The development rights and special declarant rights of builders of condominium and cooperative apartments have become a collateral value in the financing of construction under the Uniform Common Interest Ownership Act. These rights give developers the option of using certain common areas for future construction of additional units. The true value of these rights, however, is not always accurately measured. The result is the loss of some of the value of a particular project when it is assumed by another party.

Flexibility reduces shopping center developers' risks
Article Abstract:
Developers of shopping centers need great flexibility to reduce their risks in the current economic climate. Developers should make every effort to assure that their risks are limited when negotiating for a proposed site. Typically, an arrangement can be made, despite the reluctance of landowners, for an escape clause that gives the developer the option to risk only a cash deposit if the proposed center fails to get government approvals, tenant leases or financing.
