The extra territorial reach of the ECHR
Article Abstract:
The Court's jurisprudence concerning the existence and extent of liability under the Convention for the Protection of Human Rights and Fundamental Freedoms 1950 (ECHR) is analyzed to identify the underlying principles. The ECHR applied in an essentially regional context and notably in the legal space of the Contracting States was not designed to be applied throughout the world, even in respect of the conduct of the Contracting States.
