UK: STUDY ATTACKS NEW DIVORCE LAWS
Article Abstract:
A pilot initiative brought in during 1998 and designed to compel couples in the UK looking to divorce and seeking legal aid to contemplate mediation beforehand was criticised in a study released on 20 December 2000. The Legal Services Commission study, undertaken by Bristol University researchers, says that part of the Family Law Act is resulting in too much emphasis being placed on attaining legal service cost savings by redirect couples to cheaper services. The new laws were designed to achieve legal aid savings and make divorce less bitter.

Reforms may force couples to plan their divorce before they marry
Article Abstract:
The UK Lord Chancellor's Dept is considering changes to divorce law which would include making pre-nuptial agreements legally enforceable. It is even possible that legislation will include a penalty clause, with couples who do not have a pre-nuptial agreement being forced to divide marital property equally on divorce. There has already been a significant increase in the number of couples drawing up pre-nuptial agreements, and these already influence judges' decisions in divorce cases.

Article Abstract:
A new European Union regulation stipulates that the court in the country where divorce proceedings are instigated will have the exclusive right to hear the case. This ruling could benefit the many Britons who have second homes in continental Europe, as well as couples of mixed nationality.
