The hazards of urban excavation are exposed in the enumeration of potential trouble spots that can leave engineers and contractors in a deep legal hole. Environmental impact statements and superfund regulations are liabilities that arise from environmental regulations. Negligence and strict liability or trespass can be imposed by utility companies. Contractors and engineers can be liable to neighboring property owners and businesses by virtue of the lateral-support doctrine, excavation noise and business interruption damages. Local statutes and the permitting process are also to be contended with.

The fields of design and construction insurance are complicated because different companies offer different policies, and to differentiate one from the other requires the help of an expert who is aware of their terminologies. Insurance usually covers loss caused by sudden accidents, not intentional damage. Liability coverage offers a legal defense and offers solutions in cases of suits by third parties. Property insurance offers insurance for specific risks and all risks on properties, and professional liability insurance covers loss because of error, omission or negligence.

Ethical issues related to engineering profession can cause dilemma for structural engineers' decision making, and specific training in this regard can be beneficial. Civil engineers are responsible for deciding and accepting imperfect performance, since the protection of public health and safety is very important. The engineer, William Le Messurier, shows a laudable example by identifying the major flaw in the design of the 59-story Citicorp Center in midtown Manhattan and resolving the crisis.
