Public contractor establishes lost efficiency caused by differing site conditions
Article Abstract:
Bay West Inc. won a differing site conditions claim against the U.S. Army Corps of Engineers in connection with a dredging project near Guttenberg, Iowa. The Armed Services Board of Contract Appeals decided that the rocks, riprap, and other debris found on the site amounted to much more than the type specified in the contract and endorsed Bay West's "m easured mile" approach in measuring lost productivity.

Contractor compensated for changes made to comply with codes
Article Abstract:
A case of the Town of New Ross vs. Ferretti at the Court of Appeals of Indiana is won by the contractor, Ferretti Construction against the town. The case was on the payment of additional amount spent by the contractor for the construction of a fire station in the town because of the changes complying with state-approved plans and state codes and requirements.
