Chapter Eleven of the new Bankruptcy Code is a way of giving floundering businesses an opportunity to reorganize, rather than liquidate. In 1981, bankruptcy petitons are rising, up 74.5 per cent in the last year, and if the economy does not greatly improve, it will be a real test to see if Chapter Eleven can save companies. Meanwhile, Chapter Thirteen, for those whose debts are less than $100,000, is not proving to be an efficient program. It seems to be letting people avoid their debts. A technical amendments bill is before Congress. It would tighten up the entire Bankrupttcy Code.
