IBM battles start-up over 'e-business'

E Technologies Associates LLC, a small consulting company based in New York and Paris, is suing International Business Machines to prevent the US technology giant from using the "e" trademark, cleverly shaped much like the "o" in e-mail addresses. IBM, which filed for a patent to use the "e" for its new e-business (electronic business) internet products on Aug. 21, 1997, is arguing that E Technologies' claims of filing to use the same trademark on June 10, 1997 are without merit. IBM maintains that it had acquired the trademark earlier from other companies it has declined to identify. Despite IBM's launching a huge campaign for its e-business products in October 1997, E Technologies has filed for an injunction to prevent IBM from using the logo in the Netherlands' District Court in Amsterdam.

FoxMeyer trustee sues consulting firm
Article Abstract:
The bankruptcy trustee for the collapsed drug distributor FoxMeyer Corp. has filed a suit for compensatory and unspecified punitive damages against Andersen Consulting. The trustee suit, which totals $500 million in claims, was filed in state court in Houston. According to the suit, FoxMeyer claims that Andersen was negligent in the installation of a complex German business software program, which lost orders or shipped the wrong products, among other problems, causing the business to fail. Andersen maintains that the charges are false and FoxMeyer's demise was the result of its own business decisions and a highly competitive market.

Gunther International can't file results; stock trading halted
Article Abstract:
Gunther International Ltd. announced that it did not complete its results for the first-quarter of 1998. The company blamed its inability to file quarterly results on worries about the credibility of its audit report for its past fiscal year. A Gunther spokeswman said that the company would release its results for the quarter by the later half of August 1998. Gunther's fiscal first-quarter ended on June 30, 1998.
