Article Abstract:
The growing trend of companies transferring their assets to another company and filing insolvency petition thereafter is discussed. These companies, nicknamed phoenix companies, return to defraud more investors. The investigations of Australian Securities & Investments Commission and Australian Taxation Office in this context are discussed. The measures being taken to control such phoenix companies are also discussed.
