Too soft on insolvent traders?
Article Abstract:
Australia's insolvent-trading laws have too many loopholes, and insolvency practitioners and government would like to see tighter provisions to the laws and stronger penalties for breaking them. Nearly 40% of businesses have been harmed by an insolvent trading company, yet only 12 prosecutions have resulted in seven years. The Commonwealth-State Ministerial Council for Corporations (MINCO) has been studying proposals for changes to the laws and will meet on July 21, 1999, to decide on approval. When MINCO meets, it will also decide on a 10-year jail sentence and up to a $100,000 fine for insolvent trading.
