Obstacles to early settlement
Article Abstract:
There are a number of obstacles to the early resolution of a legal dispute in the UK. The dispute must be defined, and those advising the parties to the dispute have to establish the background. The process of discovery can be very time-consuming and costly, and it may be necessary to seek an expert's opinion. The parties can only be advised about the strengths of their own cases when all the evidence relating to the disputed issues has been assembled. Settlement becomes much easier when both parties are well advised.

The importance of getting agreement between experts
Article Abstract:
Most cases can benefit from frank discussion between experts but problems sometimes arise and as a result of certain cases experts' meetings have become less effective. To avoid problems it is important that the role of the experts is made clear, either that they meet to define issues for the benefit of the court or they meet with the authority of the parties to agree disputed sums.
