RANBAXY WANTS EMR TO PRECEDE PATENT REGIME
Article Abstract:
Ranbaxy Laboratories Ltd want the government to implement the exclusive marketing rights (EMRs) before granting product patents by 2005 AD. A decision whether EMR should be implemented first or whether the product patent regime should be advanced to 2000 AD is pending for recommendations by a committee of ministers. There is a view that EMRs can exploit a loophole in the legislative system to sneak in product patents, while the product patent regime would enhance direct foreign investment. However, MNCs would gain a monopoly at the expense of the domestic industry. Ranbaxy claim that the transition period given by WTO will give time to develop R&D efforts. To prevent misuse, Ranbaxy claims that EMRs should be granted only to those products for which patent applications have been filed in a WTO member country after January 1, 1995. The products should be genuine and of a company with marketing rights in the host country with a patent in a convention country. EMR would also permit exports till 2005 AD, whereas under the product patent regime, production within India would be disallowed, thereby depriving export revenue. (nr)

RANBAXY's NEW RESEARCH MOLECULE DRAWS SUITORS
Article Abstract:
Ranbaxy Laboratories has developed a molecule for benign prostatic hyperplasia (BPH), RBx 2258. The molecule will undergo an investigative new drug (IND) trials in India during next week. The company is also working on new molecule, a drug for bronchial asthma. Bristol-Myers Squibb and Pfizer Inc of the US and Synthelabo of France have approached Ranbaxy Laboratories for seeking license for these molecules. (gs)
