Sorting out certificates
Article Abstract:
Many UK architects are still concerned about issuing final certificates which indicate that they are satisfied with the quality and standards of a building project and the materials used. There is considerable uncertainty about the status of the final certificate if the declaration of satisfaction has been signed and both disclaimer stickers are in place. However, the architect cannot refuse, as the contractor can, to sign the final certificate, as there is a duty to issue the final certificate in accordance with the building contract.

A Court of Appeal case demonstrates the extent to which building contracts may be governed by implied terms. Builders often assume that they can get away with building anything if there is no specification, but the recent case shows that this is misguided. A separate case involved the degree of architectural specification freedom, where unless it is clear that a performance specification is used, the architect should specify exactly what is required.

The consequences of approval
Article Abstract:
Architects working as employer's agents under design and build contracts have no duty to approve drawings supplied by the contractor. Contractors must supply drawings to the employer and it is wise that agents should check them to see if they reflect the proposals set out in the contract. However, they should not approve drawings as this could damage any case against the contractor if the designs are faulty.
