The rising cost of cover: a diminished role for the architect and pressure on limited resources could lead to more building failures and increased insurance premiums

The way the law considers architects' responsibilities has changed dramatically over the past hundred years. In the 1980s the burden of proof in negligence cases was shifted onto the architect meaning a rise in insurance premiums. Often developers saw the architect as support and insurance if a development profit was not up to expectations. Architects' professional indemnity insurance (PII) is offered by specialised brokers and premiums are affected by the overall insurance market and the number of claims.

Professional indemnity insurance is relatively cheap and is particularly suitable for architects who are planning supervisors, appointing professionals such as mechanics and electricians or agreeing to a collateral warranty business arrangement. The insurance form requires careful reading and completion, since there are many areas which can cause difficulty. It is essential that the insurer has the necessary experience to deal with any allegations which are made against the architect.

RIBA investigates mandatory PI
Article Abstract:
The Royal Institute of British Architects (RIBA) is to inquire into professsional indemnity insurance (PI) and consider making it compulsory for members. RIBA is likely to seek changes to the law on joint liability and time limits before making PI compulsory. However, it might restrict entry to its practice directory to those with PI. PI insurance is compulsory for members of the RIAS.
