Persons in critical need of meeting deadlines within a short period of time adopt delegation as a better option but one has to be careful and check that the contract provides for any delegation and on what terms and extent. The case of Try Construction v Eton Town House Group is given as an illustration to support the argument.

According to the section 1 of the Third Parties Act 1930, the Rights Against Insurers, if the insolvent insured has a liability to a third party, the insured's rights against its insurer is transferred to the third party. Under this law, a third party only gets a right to pursue an insurer when a liability has been incurred.
