Spink v. Lockheed Corporation: the Ninth Circuit outlaws pension plan window waivers
Article Abstract:
The Ninth Circuit Court of Appeals' 1995 decision in Spink v. Lockheed holds waiver releases signed as part of an early retirement window program to be in violation of ERISA. Since these waivers are typically executed in exchange for enhanced benefits, the decision's chilling effect on employers could work against the interests of other retirees. The court failed to determine whether Lockheed acted as a fiduciary in amending its pension plan, which undermines its ruling on the waiver as a prohibited transaction under ERISA.
