Learn to stand up to main contractors
Article Abstract:
Subcontractors should not acquiesce to the ploys of main contractors when negotiating contracts. The main contractor uses tactics like altering the standard form of contract, undervaluation and vague scheduling to select and weaken sub contractors but does not expect them to be accepted by serious negotiators. Taking a firm line on the standard contract, without trying to be deceptive or unhelpful will bring success. However, the subcontractor can do nothing to prevent the mian contractor becomming insolvent and should insure against this.

Arbitration and change
Article Abstract:
Changes to the Arbitration Act under discussion in the United Kingdom parliament will prevent the courts from overriding the arbitration clause in a contract. This may lead to contractors deleting the arbitration clause which is standard in contracts for construction work. In the past arbitration has failed when several different parties have been involved within a dispute causing a variety of different conclusions from arbitration tribunals. A better system could allow the courts to involve arbitrators in suitable cases.
